customer’s problem
Hanna and her family had a really frustrating experience with Wizzair when her Bucharest-Liverpool flight was rescheduled last minute, with over a 6-hour delay pushing the new arrival into the early hours of the next day. New time was completely impractical for her, so she had to cancel plans and decided not to fly. She called the Wizzair call center ahead of departure to inform them she would not be flying.
UK261 regulation rights
EU Regulation 261/2004 clearly states that a delay over 5 hours counts as a cancellation, making passengers eligible for compensation if they weren’t notified at least 14 days in advance. Wizzair, however, claimed “exceptional circumstances” and rejected her compensation claim without going into any details.
our solution
Looking into Hanna case we found out why the delays really happened: the airline packed in way too many flights for one aircraft. For example, there was a Castellon-Bucharest flight scheduled to land at 14:30, then a Bucharest-Basel flight set to depart at 12:55 (how’s that possible?), followed by a Basel-Bucharest arrival at 18:30, and then the Bucharest-Liverpool flight at 17:30. It’s appeared impossible to perform than schedule on time unless you have a time machine! We escalated Hanna's case to Aviation ADR providing detailed arguments that the delay happened due to operational reasons, an overpacked schedule and she got 1400 GBP compensation for 4 passengers to cover her inconvenience.

customer’s problem
Michael's and his girlfriend's flight W62428 Reykjavik to Budapest was first canceled and then rescheduled for nearly 23 hours later, at 10 pm the next day, June 27th. However, they had no choice but to take the rescheduled flight because no better alternatives were presented. Michael booked a hotel and spent something on meals and local transport in Reykjavik which is costly in Iceland.
UK261 regulation rights
When he asked for a reimbursement of expenses and compensation, Wizzair refunded direct expenses, credit to them but rejected Eu261 compensation claims. They said it was due to “ATC restrictions” but did not specify where these restrictions were happening which aircraft or airport affected and what steps they took to minimize the impact.
